Abstract

The institution of guilt is a fundamental concept in the field of law, being one of the essential elements that imply legal responsibility. Essentially, guilt reflects the person's mental or moral attitude towards the act committed and its consequences. Establishing guilt is essential to incurring legal liability.

Guilt, as a determining element of individual responsibility, is a concept also present in canonical theology, respectively in ecclesiastical legislation. Although the paradigm differences are significant, since ecclesiastical law has an essentially spiritual and moral dimension, the identification, definition and sanction of guilt remain fundamental concerns for the organization and discipline of ecclesial life.
